• Account Creation: To access certain features of the Services, you may be required to register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
• Account Responsibility: You are solely responsible for maintaining the confidentiality of your account password and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security.
• No Sharing: You may not share your account or password with any other person.
• Termination: We reserve the right to suspend or terminate your account at any time, with or without notice, if we suspect any breach of these Terms.

4. Digital Products and Licenses

• Nature of Products: Skycart offers digital products including, but not limited to, software licenses, AI tool subscriptions, premium account vouchers, ebooks, PDFs, courses, and other digital resources.
• License/Access: When you purchase a digital product, you are typically acquiring a license to use that product, not ownership of the underlying intellectual property. The terms of such licenses (e.g., single-user, duration, number of devices) are as specified in the product description.
• Redemption: It is your responsibility to redeem or activate purchased licenses/vouchers within any specified validity periods. Skycart is not responsible for expired licenses due to customer inaction.
• No Resale: Unless explicitly stated otherwise, you may not resell, redistribute, or transfer any digital products or licenses purchased from Skycart.

5. Payment and Pricing

• Currency: All prices are listed in Indian Rupees (INR) unless otherwise specified.
• Accuracy: We strive to ensure all pricing information is accurate. However, errors may occur. In the event of a pricing error, we reserve the right to refuse or cancel orders placed at the incorrect price.
• Payment Processing: All payments are processed through secure third-party payment gateways. Skycart does not store your full payment card details.
• Taxes: Prices displayed may be exclusive of applicable taxes. You are responsible for all applicable taxes and duties associated with your purchase.

6. Refund Policy

As detailed in our dedicated Refund Policy page, due to the nature of digital goods, all sales are final and non-refundable. Exceptions may be considered only in cases directly attributable to an error on Skycart's part, as outlined in the Refund Policy. By making a purchase, you acknowledge and agree to our Refund Policy.

7. User Conduct

You agree not to use the Services for any unlawful or prohibited purpose, including but not limited to:

• Violating any applicable local, national, or international law or regulation.
• Infringing upon the rights of others, including intellectual property rights.
• Transmitting any material that is harmful, offensive, abusive, or otherwise objectionable.
• Attempting to interfere with the proper functioning of the Services or compromise their security.

• Promoting or facilitating illegal activities, including but not limited to, the distribution of "cracked" software or engagement in illicit social media manipulation.

• Skycart Content: All content on the Skycart website, including text, graphics, logos, images, software, and the compilation thereof, is the property of Skycart or its suppliers and protected by copyright and other intellectual property laws.
• Product Content: Digital products sold on Skycart are the intellectual property of their respective creators or licensors. Your purchase grants you a license to use them according to their specific terms, but does not transfer ownership or intellectual property rights.
• Trademarks: The Skycart name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Skycart or its affiliates or licensors. You must not use such marks without our prior written permission.

9. Disclaimers and Limitation of Liability

• "As Is" Basis: The Services and all digital products are provided on an "as is" and "as available" basis, without any warranties of any kind, either express or implied, including but not limited to, implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
• No Guarantee: Skycart does not warrant that the Services will be uninterrupted, error-free, secure, or free of viruses or other harmful components. We do not guarantee the accuracy, completeness, or reliability of any content or information provided through the Services.
• Third-Party Products/Services: While we facilitate access to third-party digital products and services (e.g., through licenses, vouchers), Skycart is not responsible for the functionality, performance, or support of these third-party offerings. Any issues with third-party products should generally be directed to their respective developers or providers.

• Limitation of Liability: To the fullest extent permitted by law, in no event shall Skycart, its affiliates, directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Services; (ii) any conduct or content of any third party on the Services; (iii) any content obtained from the Services; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contrac t, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage.

   

   

• Total Liability: In no event shall Skycart's total liability to you for all damages, losses, and causes of action exceed the amount paid by you, if any, for accessing the Services or purchasing products giving rise to such liability.

10. Indemnification

You agree to indemnify, defend, and hold harmless Skycart, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Services, including, but not limited to, your User Contributions, any use of the Services' content, services, and products other than as expressly authorized in these Terms.

11. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. You agree that any legal action or proceeding arising out of or relating to these Terms or the Services shall be brought exclusively in the courts located in Prayagraj, Uttar Pradesh, India.

12. Miscellaneous

• Entire Agreement: These Terms, together with the Privacy Policy and Refund Policy, constitute the entire agreement between you and Skycart regarding the Services.
• Severability: If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced.
• Waiver: No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term, and Skycart's failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.
• Assignment: You may not assign or transfer your rights or obligations under these Terms without our prior written consent. Skycart may assign its rights and obligations under these Terms without restriction.
